“Ikukuoma” Foundation: High Chief Nwokie Gives Insight on CAC Registration, Calls For Order

Ezinihitte Mbaise, Imo born philanthropist and the Chief Executive Officer of “Ikukuoma Foundation”, High Chief Summers Nwokie has decried falsehood and blackmail on his person making rounds in the media as an “Impersonator” regarding the formal registration of “Ikukuoma Foundation” by the Corporate Affairs Commission, CAC of Nigeria as another group lay claims of ownership of the foundation’s ‘name’.
Chief Nwokie disclosed this in a letter written to the group through the Lawyer to the foundation, Emmanuel Okpara, Esq, and made available to this newspaper recently.
The letter clarifies the issues surrounding the mixup in the widely circulated news reports against High Chief Nwokie stressing that ” the founder has followed all due process in line with set down Nigerian Laws in driving the Ikukuoma Foundation” and has started its formal registration with CAC with an approved serial number CAC/COM/2020/0924280348948, which was issued after name reservation.
“CORRECT POSITION REGARDING THE REGISTRATION OF IKUKUOMA FOUNDATION /DEMAND TO RETRACT DEFAMATORY STATEMENT AND TENDER PUBLIC APOLOGY: It is our brief that sometime in September, 2020 our Client made an application to the Corporate Affairs Commission (herein after referred to as C.A.C.) seeking the consent of the Registrar General to register the name “IKUKUOMA FOUNDATION”, and the said application was granted in a reply letter from the C.A.C dated the 23rd September, 2020. Also, a consent code No: CAC/COM/2020/0924180348948 was issued to our Client to proceed and register the said name ”IKUKUOMA FOUNDATION””
“Our Client further made an application to C.A.C. to check the availability of the name ”IKUKUOMA FOUNDATION”, and where the name is available, to reserve same for 60 (Sixty) days within which he would commence and perfect registration of the foundation. The same said application for Availability and Reservation was approved by the C.A.C. on the 14th October, 2020”
“Based on the foregoing, our client proceeded to comply with all the C.A.C. registration requirement to get the ”IKUKUOMA FOUNDATION” registered, paid all the necessary fees and since then, is awaiting the registration of the Foundation by the C.A.C”
The foundation noted that it is thoroughly undergoing the legal process of seeking a lasing solution to the mixup surrounding the formal name registration of ‘Ikukuoma Foundation’ while calling on the contending party not to see or portray High Chief Summers Nwokie in bad light as an ‘Impersonator’ having acted in accordance with due Process adding that it is the sole responsibility of CAC to approve and deny use of restricted and prohibited Business Names both at the stage of Application for Consent or at the stage of Application for Availability and Reservation.
“We have commenced steps with C.A.C. to get the unfortunate situation settled by getting a name which is neither restricted nor prohibited approved for our Client’s use”
“Sequel to the above, we hereby state that our Client has at all times acted in good faith regarding the registration and use of the name ”IKUKUOMA FOUNDATION”. Thus, our Client have no such intention to impersonate anyone or your company”
“Recall that the responsibility to identify and deny approval of restricted and prohibited names of Business Names, Companies Names and Incorporated Trustee’s Names, either at the stage of an Application for Consent or at the stage of Application for Availability and Reservation, is solely that of C.A.C”
“Recall further, that where an application for consent and reservation is approved, there is a very genuine presumption that the said reserved name has not been registered with the C.A.C. and such name cannot also be approved for any other person until the expiration of the 60 (sixty) days granted to the applicant by C.A.C. An applicant at such stage is permitted to start using the reserved name to run business pending the full registration of the foundation”
The management of the foundation who frowned at the level of damage done on the founder stressed the need to sort the mixup with CAC while demanding Retraction of all copies of the said defaming publication as well as Tender an apology to High Chief Summers Nwokie within twenty four(24)hours
“However, your client has portrayed our Client as an impersonator, criminal, cheater, and someone not worthy of public trust in their statements and publications which are on wide spread especially on social media. This is demeaning of our Client’s character and is costing him his reputation and business”
“Therefore, you are hereby demanded to comply with the following within 24 (Twenty Four) hours of service of this letter on your office, to wit;
- Retract all copies of the said publication which are demeaning of our Client’s character, and ensure the prohibition of further publication or sharing of such statement.
- Tender an apology to our Client and cause same to be published on 2 (Two) national dailies and all social media platform wherein such publication was made
TAKE NOTICE that upon your failure to comply with these demands and upon the expiration of the 24 (Twenty Four) hours, we have been further instructed to take every necessary legal step to enforce the rights and remedies available to our client”
